Introduction
These General Conditions of Sale govern the sale of products of the company SADSHARK, exclusively present on the sitewww.sadshark.frand are accessible on the same site by the buyer at the time of the order.
The site as well as the products and contents present on the sitewww.sadshark.frare the exclusive property of SADSHARK.
According to « Article 111-1 » « Article 112(1) » and « Article 112-2 » All works and contents on SADSHARK's website and social networks are protected by copyright and image rights. Any partial or complete reproduction or copy must be subject to prior authorisation by SADSHARK.
Any reproduction or copy made without the agreement of SADSHARK may be prosecuted.
1 - Orders and rates
Any order for any of the products on the sitewww.sadshark.fraffirms the consultation and acceptance of these terms and conditions of sale. Validation of the shopping basket with electronic signature value.
The rates indicated under each work and content are all taxes included but excluding shipping costs. Delivery costs will be indicated to the buyer at the time of validation of the order. SADSHARK reserves the right to change the prices on the site at any time. However, only the price indicated at the time of purchase will be applicable to the buyer.
The sales contract comes into force after sending the order validation email by SADSHARK, « order confirmed ».
Anyone placing an order on the sitewww.sadshark.frcertifies that you have read and accepts the general terms and conditions of sale. The buyer certifies by the validation of the order to be major unprotected, nor minor without parental permission at the time of purchase. SADSHARK cannot be held liable otherwise and will not make any refunds.
If a product on the sitewww.sadshark.frSADSHARK agrees to notify the buyer within 48 hours and to make the refund.
2 - Products
Tables and drawings on the sitewww.sadshark.frare entirely handmade by SADSHARK Any other content on the site relating to a different impression is entirely made by the artist in advance. Each work has an artist's signature « MAD »
The photographs put online to represent the works are not contractual. There may be a variation of colour or volume. The buyer can find all the characteristics of a product in its description. Products in a collection are the subject of a unique creation. No reproduction of the same table may be made except after contact and agreement between SADSHARK and the buyer and payment thereof. SADSHARK reserves the right not to accept the reproduction of a product.
Non-collection products have a number of very specific reproductions. SADSHARK is a decision maker for the resupply of these products on site or not.
3 - Custom products
The buyer can make a request for custom creation. For any custom creation request, the buyer is required to contact SADSHARK in advance via the email:itssadshark@gmail.comAfter exchange, quotation and validation of this order, a 50% deposit will be requested from the buyer. The remainder will be done by the buyer once the creation is completed and before the creation is sent. The company SADSHARK undertakes to provide the buyer with evidence confirming the realization of the creation once completed. SADSHARK reserves the right not to accept a custom order.
SADSHARK cannot be held responsible in case of buyer error when ordering (bad dimensions, writing, spelling, colors etc...)
4 - Certificate of authenticity
All hand-painted or hand-drawn works on the sitewww.sadshark.frbe accompanied by a certificate of authenticity.
Any other content present by impressions will be numbered and signed by the artist « MAD ».
5 - Payment
Payments will be made by credit card or PayPal (payment in 4 times without charge possible) which uses SSL protocol. In this way, all your data is encrypted. Payment of a product on the sitewww.sadshark.frbased on buyer authentication.
No bank data is transmitted to the sitewww.sadshark.fr. The PayPal server is directly connected to the bank servers.
In case of fraudulent use of your bank card by a third party, the company SADSHARK and are artist « MAD » cannot be held liable and no reimbursement can be made without legal proof.
6 - Delivery
Delivery of one or more products ordered by the purchaser shall be made at the address indicated at the time of the order and only on the National Territory (excluding DOM TOM).
Delivery is Monday to Friday from 9am to 5pm excluding holidays.
Your orders are delivered by post as recommended A/R via the platform « BOXTAL »
Delivery time for products on the websitewww.sadshark.fris 14 working days on average, depending on the carrier chooses when validating the order.
The delivery time for a custom order will be set by the artist SADSHARK when contacting and validating the order with the buyer.
A delivery may be delayed or lost. The buyer is required to notify SADSHARK in one of these cases. SADSHARK undertakes to make every effort to find the package. If applicable, SADSHARK undertakes to reimburse the buyer or to reproduce the canvas in case of a collection product or to return the corresponding product according to the buyer's choice.
In the event that the buyer does not collect the parcel from the post office or does not respond to the delivery by SADSHARK, the costs of returning the parcel will be borne by the buyer. SADSHARK will not be liable and no reimbursement will be made.
All products are sent in perfect condition. Packages are protected in the best way during shipments and deliveries. The buyer must warn the delivery person and SADSHARK of the slightest trace of shock. SADSHARK cannot be held responsible if it is not.
SADSHARK cannot be held liable in the event of failure to perform the contract concluded for events not subject to our will at the time of delivery, particularly during the period of postal strikes.
7 - Right of withdrawal
In accordance with article L221-18 of the Consumer Code the buyer has 14 days from receipt of the package to return the product at his expense (Art L221-23).
Article L221-21 specifies that the buyer must notify SADSHARK of this reference at its expense.
We advise you to make referrals by recommended A/R. Only packages returned in perfect condition will be refunded. If a product returns in poor condition, SADSHARK reserves the right to make a partial refund or no refund depending on the condition of the product concerned.
If all conditions are met according to law and the product returns intact, SADSHARK will proceed with the refund after proof of return from the buyer receiving the product by: SADSHARK.

In accordance with article L221-28 paragraph 3 of the Consumer Code, no refund will be made on custom orders.
8 - Computer networks
By these terms and conditions of sale, you agree that SADSHARK cannot be held responsible in the event of logistical and computer failures, computer viruses, data theft, web site problemswww.sadshark.frwrong transmission of electronic messages, loss of data or transactions, malicious use of all written and visual data and various information.
SADSHARK shall not be held responsible for any event arising from a case of major or unpredictable force as well as any cause not dependent on the will of SADSHARK.
9 - Protection of personal data
The sole purpose of all data reported to SADSHARK by the purchaser is the processing and routing of orders in their entirety.
The purchaser certifies the accuracy of this information. Otherwise, SADSHARK reserves the right to cancel the order and the buyer accepts that his false statements are contrary to the general terms of sale.
The data communicated during an order are processed with your consent in accordance with Article 6.1 of the GDPR.
10 - Applicable law
These general conditions of sale are subject to French law.
